We are delighted to design and create a piece of jewellery for you. Thanks for trusting us.
The expected completion date for the jewellery will be at least 8 weeks from the date the final design is agreed to with the store, it is also dependent on postage. When the piece is completed Nina’s will contact you and the item must be paid for in full within three business days.
If by prior arrangement the design is to be paid for in instalments, this is not a lay-by in the matter that there is no opportunity for the purchase to be cancelled as this is a special order and not subject to the conditions of a normal layby. Payment is made in two equal parts and completed within three months of the design completion. If the purchase is not completed all money paid will be forfeited.
Special Orders
Minimum deposit - 50% of the purchase price.
Special Order is 50% of the purchase price, or 100% if under $500.
A special order is not a layby.
When Nina’s customer cancels a Special Order the cancellation charge is the amount of the minimum deposit.
Should our customer fail to honour the Special Order by not completing payment within three months. Nina’s shall contact our customer directly after three months from completion and advise that the Special Order will be cancelled after 7 days of the notice unless full payment is received. Should our customer not pay outstanding monies within the seven days the Special Order will be cancelled, goods returned to stock if possible.
There is no cancellation charge if goods are unable to be supplied by Nina’s on the agreed date.
If there is a ‘special order’ the purchase cannot be cancelled and must be paid in full. If the purchase is not honoured all monies paid are forfeited. A ‘special order’ is defined as either a make/remake/repair or order of jewellery not currently stocked in the stores.
It is Nina’s customer’s responsibility to advise the store of any changes of address.
Intellectual Property
1. Nina’s creates intellectual property in all Jewellery and designs we make. Intellectual property rights in any design we create, even if created in collaboration with a client's suggested vision or concept, remains our property. Where we have designs, drawn or written, produced pictures, diagrams and sketches for you, then the copyright in those plans, designs and documents shall remain vested in us.
2. Nina’s hold all copyright and related rights in the design, models, patterns, moulds and samples, CAD Design files, design renderings, waxes and models including any modification and amendments to the design.
3. In respect of design and Company branding specifically created for the Client as a part of this Agreement, Nina’s maintains all of the copyright, and other intellectual property rights used or subsisting in the Jewellery.
4. Nina’s reserves the right to take photographs of the design and the final product and the Client agrees these pictures may be used for promotion, display, advertisement, internet use, or publication unless this permission is revoked by the Client. Nina’s accepts that in certain circumstances the image of a jewellery design is a sensitive item and Nina’s will endeavour to protect our customer if this is requested.
5. Both parties agree in principle that Nina’s is the authority on resources and designs for the item/s and the technical knowledge given to the client as part of the design process.
6. The client agrees that all designs, plans, and images directly associated with the making of the Custom Jewellery Item by Nina’s remain the intellectual property of Nina’s.
7. This Agreement also covers that the Custom-made item/s have individual design alterations or rearranged features that create a non-standard personalized item/s. It includes all resources, including intellectual property on all resources required to make and complete the ordered item, specifically: metals, gems, design and fit.
8. The User agrees to hold the Jeweller harmless from and against all claims, liabilities and expenses arising out of any potential or actual copyright misappropriation or infringement claimed.
